Please read these Terms of Service ("Terms") carefully before using our website or booking any tour services. These Terms constitute a legally binding agreement between you and our tour guide service company operating in Toronto, Canada.

1. Acceptance of Terms

By accessing our website, booking a tour, or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services or website.

2. Tour Bookings and Payments

2.1 Tour Reservations

Tours can be booked through our website, by email, or by phone. A tour booking is not confirmed until you receive a confirmation email or other written confirmation from us.

2.2 Payment Terms

Payment methods accepted include credit cards, debit cards, and electronic transfers. Unless otherwise specified:

  • For standard tours, a 25% deposit is required at the time of booking, with the remaining balance due 7 days before the tour date.
  • For custom private tours, a 50% deposit is required at the time of booking, with the remaining balance due 14 days before the tour date.
  • For tours booked less than 7 days in advance, full payment is required at the time of booking.

All prices are in Canadian Dollars (CAD) and include applicable taxes unless otherwise stated.

2.3 Price Changes

Tour prices displayed on our website are subject to change without notice until your booking is confirmed. Once your booking is confirmed, your price is guaranteed.

3. Cancellations and Refunds

3.1 Cancellation by You

Cancellation policies vary by tour type:

  • For standard tours:
    • Cancellations made 14 or more days before the tour date receive a full refund minus a 5% processing fee.
    • Cancellations made 7-13 days before the tour date receive a 75% refund.
    • Cancellations made 3-6 days before the tour date receive a 50% refund.
    • Cancellations made less than 3 days before the tour date are non-refundable.
  • For custom private tours:
    • Cancellations made 30 or more days before the tour date receive a full refund minus a 10% planning fee.
    • Cancellations made 14-29 days before the tour date receive a 50% refund.
    • Cancellations made less than 14 days before the tour date are non-refundable.

All cancellations must be submitted in writing to [email protected].

3.2 Cancellation by Us

We reserve the right to cancel tours due to unforeseen circumstances, including but not limited to severe weather conditions, safety concerns, insufficient participants, or force majeure events. In the event we cancel a tour:

  • You will receive a full refund of all payments made.
  • Alternatively, you may choose to reschedule for another date or select a different tour of equivalent value.

We are not responsible for any additional expenses incurred as a result of our cancellation (e.g., non-refundable travel arrangements).

3.3 Tour Modifications

We reserve the right to modify tour itineraries, routes, or included features if necessary due to weather, road conditions, attraction closures, or other circumstances beyond our control. In such cases, we will make reasonable efforts to provide services of equal or greater value.

4. Tour Participation and Conduct

4.1 Physical Requirements

You are responsible for assessing whether a tour is suitable for your physical abilities. Our tours involve varying degrees of physical activity, including walking on uneven surfaces. Please inform us of any mobility issues or health concerns prior to booking.

4.2 Participant Conduct

You agree to follow all instructions given by tour guides and to behave in a manner that is respectful to other participants, the general public, and the locations visited. We reserve the right to remove any participant whose conduct is deemed disruptive, dangerous, or offensive, with no refund provided.

4.3 Punctuality

Please arrive at the designated meeting point at least 10 minutes before the tour start time. Tours will depart as scheduled, and we cannot guarantee that late participants will be able to join the tour once it has begun. No refunds will be provided for missed tours due to tardiness.

5. Liability and Insurance

5.1 Assumption of Risk

You acknowledge that participating in tours involves inherent risks. By booking a tour, you voluntarily assume all risks associated with participating in the tour, including but not limited to physical injury, property damage, or loss.

5.2 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your participation in tours or use of our services
  • Personal injury or property damage of any nature
  • Unauthorized access to or use of our servers and/or any personal information stored therein
  • Any loss or damage incurred as a result of your reliance on information provided on our website

Our total liability for any claim arising out of or relating to these Terms shall not exceed the total amount paid by you for the specific tour giving rise to such claim.

5.3 Travel Insurance

We strongly recommend that all participants obtain comprehensive travel insurance covering trip cancellation, medical emergencies, personal injury, and property damage/loss.

6. Intellectual Property

All content on our website, including text, graphics, logos, images, audio clips, digital downloads, and software, is our property or that of our content suppliers and is protected by Canadian and international copyright laws. You may not reproduce, modify, distribute, or publicly display any content from our website without prior written consent.

7. Privacy

Your use of our services is subject to our Privacy Policy, which is incorporated into these Terms by reference.

8. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after any changes indicates your acceptance of the revised Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law provisions.

10. Dispute Resolution

Any dispute arising out of or relating to these Terms shall be resolved through negotiation in good faith. If negotiation fails, the dispute shall be submitted to binding arbitration in Toronto, Ontario, in accordance with the rules of the ADR Institute of Canada.

11. Miscellaneous

11.1 Entire Agreement

These Terms constitute the entire agreement between you and us regarding the subject matter hereof and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written.

11.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.

11.3 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms, in whole or in part, without your consent.
